TRAI proposes regulatory body for AI development

TRAI has proposed a framework to regulate the development of AI and establish a statutory body to oversee it in India. The recommendations were part of a comprehensive set of suggestions on “Leveraging Artificial Intelligence and Big Data in the Telecommunication Sector.”

The proposed statutory body, named the “Artificial Intelligence and Data Authority of India” (AIDAI), will be responsible for creating regulations regarding AI, especially regarding its responsible use. TRAI emphasized the significance of this move amidst the ongoing global debate on the advantages and risks associated with AI and generative AI. Many countries are actively working on norms to govern the use of this transformative technology, which has the potential to reshape various industries, PTI reported.

The regulatory framework, according to TRAI’s recommendations, should include an independent statutory authority and a Multi-Stakeholder Body (MSB) serving as an advisory body to the proposed statutory authority. The framework should also categorize AI use cases based on their risk and regulate them accordingly with the principles of responsible AI.

TRAI stressed the urgency of establishing the AIDAI to ensure the responsible development of AI in India across all sectors. The scope of AIDAI should encompass making recommendations to create a national-level mechanism involving state governments, local bodies, and other agencies to adopt a national policy on data governance. AIDAI’s functions may also include defining principles of responsible AI and their application based on risk assessment.

Additionally, AIDAI should ensure that responsible AI principles are adhered to throughout the entire lifecycle of AI frameworks, including design, development, validation, deployment, monitoring, and refinement. It should also propose a uniform framework for sharing government data with industry, educational institutes, R&D centers, startups, etc., while adhering to privacy and other applicable laws and policies.

Furthermore, AIDAI is tasked with developing a model AI governance framework to guide organizations in deploying AI responsibly. It should also create model ethical codes to be adopted by public and private entities in various sectors.
