Meta delays new ad terms to Nov 20 amid EU Scrutiny

Meta Platforms has postponed the enforcement of its revised Commercial Terms and Self-Serve Ad Terms to November 20, 2026, extending the original October 30 deadline amid regulatory scrutiny and concerns raised by publishers in Europe. The dispute centres on allegations that the updated contractual terms could give Meta broad rights to scrape publisher content and online archives to train its artificial intelligence models.

According to a Reuters report, the delay follows complaints filed by media publishers and digital advertising groups with antitrust regulators in the European Union and the United Kingdom. The groups have raised concerns about the potential implications of Meta’s revised terms for publishers’ control over their content and its use in commercial AI development.

A Meta spokesperson said the extension would give the company more time to clarify how its automated web crawlers operate and reassure partners that website owners can continue to use standard protocols to opt out of AI data collection. The company has denied the allegations, maintaining that the revised terms are intended to streamline advertising management while respecting established web-crawling standards.

However, publishing organisations have called for stronger action. The European Publishers Council (EPC) reiterated its demand for regulators to suspend the revised terms entirely, arguing that the delay alone does not address the underlying concerns about publishers’ rights and consent.

EPC Executive Director Angela Mills Wade said that maintaining a business profile or purchasing subscription advertising units on Meta’s platforms should not give the company blanket commercial rights over publishers’ online content and other digital assets without explicit, separate consent.

The European Commission has welcomed Meta’s decision to postpone enforcement while continuing its preliminary review of the matter. The case highlights growing tensions between technology companies seeking access to online content for AI development and publishers seeking greater control over how their material is used.

Separately, the EU competition regulator confirmed that it had issued formal requests for information to technology platforms that have yet to publish the required summaries of the training datasets used to develop their commercial AI models. The move forms part of wider regulatory scrutiny of transparency around AI training data.

For publishers, the dispute raises questions about whether existing advertising agreements could affect their ability to control the use of their content in AI training. They argue that access to advertising services should not automatically translate into permission to use their web assets for other commercial purposes.

Meta’s decision to push back the deadline gives the company additional time to address these concerns, but opposition from publishing groups remains. The European Commission’s ongoing review will be closely watched as regulators assess the implications of the revised terms for competition, publisher consent and the use of online content in commercial AI systems.
