Trimurti Films moves Bombay HC over ‘Saat Samundar Paar’ use in film teaser

Trimurti Films has approached the Bombay High Court with a copyright infringement suit against Dharma Productions, Namah Pictures, music label Saregama and rapper Badshah, alleging unauthorised use of the iconic song ‘Saat Samundar Paar’ from the 1992 film ‘Vishwatma’ in the teaser of the upcoming Hindi film ‘Tu Meri Main Tera Main Tera Tu Meri’.

According to an UNI report, the production house has contended in its petition that the teaser prominently features the song’s signature beats and hook line without seeking consent from the original producer. Trimurti Films has sought urgent ad-interim and interim injunctions restraining further use of the track, along with a direction for disclosure of all licensing agreements connected to the song and damages to the tune of Rs 10 crore.

The suit has gained urgency as the film, starring Kartik Aaryan and Ananya Panday in lead roles, is scheduled for theatrical release on December 25, 2025. The petitioner argued that no artistic or financial consent was obtained prior to using the song and that such unauthorised incorporation amounts to copyright infringement as well as a violation of moral rights.

While Saregama holds distribution rights to ‘Saat Samundar Paar’, Trimurti Films maintained that the label’s agreement does not permit it to grant film synchronisation licences without explicit approval from the original producer. The petition stated that Saregama was granted only limited mechanical rights under a 1990 agreement and had no authority to license the song for synchronisation, remix or adaptation in a new film.

The production house further alleged that the respondents acted in concert, misrepresented their rights and engaged in passing off, thereby creating a false association with Trimurti Films. It claimed that the unauthorised use has caused irreparable harm and amounts to misrepresentation and unfair trade practices.

Apart from injunctions, Trimurti Films has sought delivery-up of all infringing material for destruction, disclosure of all agreements executed in connection with the song’s usage, and an account of profits earned by the defendants as an alternative relief. The petition also noted that Saregama has filed a caveat anticipating the suit.

The matter came up before a single bench of Justice Sharmila Deshmukh, who granted time to the defendants to file their replies. The case has been listed for further hearing on December 22. Senior advocate Venkatesh Dhond, assisted by advocate Hiren Kamod, appeared for Trimurti Films, while the suit was filed through advocates Rashmi Singh and Karan Khiani.
